This course will be of benefit to you if you already have some knowledge of personal injury litigation but wish to gain knowledge of how to conduct clinical negligence litigation.
Overview
This introductory course covers the basic law and practice in a clinical negligence claims, mainly from the perspective of the claimant’s solicitors. It identifies the key differences between clinical negligence litigation and other types of personal injury litigation.
By the end of this course you will be able to:
- Appreciate the importance of assessing the merit of a new clinical negligence case.
- Be able to take instructions from a new clinical negligence client and identify the correct limitation date.
- Advise your client on funding options.
- Understand breach of duty, causation of injury and recoverability of damages.
- Obtain your client’s key medical records.
- Draft a detailed witness statements compliant with CPR.
- Properly instruct experts on liability and causation and assess expert evidence.
- Comply with the Clinical Disputes Pre–action Protocol
- Quantify your client’s claim
- Appreciate when it is appropriate to instruct counsel.
- Issue and serve legal proceedings,
- Analyse the Defence with assistance of your medical experts
- Understand Multi Track Directions up to and including Joint Settlement Meetings and trial
- Appreciate issues specific to dealing with fatal claims and claims on behalf of children
