This course will be of benefit to practitioners with some experience of Commercial or Consumer litigation but who wish to enhance their knowledge of some of the essential areas of Contract law.

Overview

The course covers the common type of litigation where breach of one of the implied terms is alleged and the defence raised is that the right to reject has been lost and/or that the seller or supplier is entitled to rely on an exclusion clause. Each of the implied terms is examined in detail together with the doctrines of acceptance and affirmation and the regulation of exclusion clauses at Common law, under UCTA or the 2020 Regulations.

Topics covered on this course will include

• Which Act regulates which type of contract – the Sale of Goods Act 2020, the Supply of Goods (Implied Terms) Act 2020 or the Supply of Goods and Services Act 2020
• Implied Terms as to Title, Quality, Fitness for Purpose and any Description given to the goods or services
• The Sale and Supply of Goods to Consumers Regulations 2020
