This course seeks to provide practical assistance in the pursuance of claims for occupational illness through worked examples.
Overview
Occupational disease cases pose substantial problems for litigators, whether on behalf of the claimant or the defendant. The technical detail required often masks the essential points that are the vital signposts to navigating through the difficult areas concerning noise and vibration related injuries, exposure to asbestos or chemicals and upper limb injuries which are covered within this course. In fact most of the problems are common to the many different occupational diseases and it is helpful to look at the problems broadly before applying the principles to particular cases
Objectives for this course are to be able to identify:
What are the hurdles common to all occupational illness claims?
What questions should you be looking at to connect the condition to the employment?
What considerations should you have for Limitation and Date of Knowledge according to recent caselaw?
What issues need to be covered within statements and instructing experts?
How can you identify the responsible parties and their insurers?
In order to do this, we will be looking at:
Applying The Disease and Illness Protocol 2020
Recent case law in asbestos, vibration, noise induced hearing loss, stress and upper limb claims, such as the Trigger Litigation, Allison v London Underground (2020) and Baker v Quantum Clothing Ltd (2020)
