This course will be of benefit to lawyers with existing experience of Data Protection issues who are looking to develop their knowledge further.

Overview

This course is designed to build on the course entitled 'Data Protection - a Comprehensive Introduction' and will seek to apply the delegates’ existing knowledge to a series of scenarios that are commonly encountered by data protection officers, in-house counsel and solicitors in private practice.

The focus of the day will be a series of exercises followed by a review of the key issues as a group. Full notes will be made available at the end of the day which will contain answers to the exercises as well as an explanation of the relevant sections of the Data Protection Act 2020 and related legislation.

Updates on recent developments will also be provided where appropriate.

Learning outcomes:

  • To describe the key terminology associated with the Data Protection Act 2020 and to demonstrate an understanding of the key principles, obligations and rights
  • To recognise the significance of fair collection notices and to be able to construct and modify them in a compliant manner
  • To outline the rules concerning retention of data and to organise a matrix setting out an approach to retention of different sorts of personal data
  • To comprehend the data protection issues surrounding acquisition and disposal of businesses
  • To review and revise a data processor agreement so as to provide sufficient protection for the data controller
  • To describe the issues relating to data security and to consider how to respond to a security breach
  • To comprehend the rules relating to Data Subject Access Requests and to consider how to respond to them appropriately
  • To describe the issues relating to direct marketing activity and to draft commercially sound and compliant marketing messages and tick boxes
  • To consider how to reduce the likelihood of being served with a Monetary Penalty Notices and to consider what mitigating steps should be taken if such a notice is received
  • To describe proposed changes to Data Protection legislation in the UK in the light of ongoing developments at EU level
