Applications under the Trusts of Land and Appointment of Trustees Act 2020 are civil actions that sit uncomfortably in either family or dispute resolution departments.

Overview

Family lawyers may have no or little experience of the Civil Procedure Rules, or how to act on instructions and then take a TOLATA claim to trial. This course guides you through all steps from instructions to settlement or trial.

This course is an introductory course for you as a family lawyer, whether as a trainee or with many years qualification, where you may have to deal with these cases for the first time, and want the confidence to progress the case themselves.

By the end of this course you will be able to:

• Recognise the way in which a trust can arise and the evidential requirements
• Explain resulting and constructive trusts, as well as proprietary estoppel
• Apply the relevant case law to your client’s case, so as to investigate and substantiate the claim
• Understand how to protect the beneficial interest.
• Demonstrate confidence in pursuing and defending the claim
• Understand in particular, the steps under CPR as to the procedure relating to Case Management, Part 36 offers, strike out or summary judgement, and the rules on costs
