This course will be of benefit to lawyers or HR professionals who are starting out with a Tribunal caseload and/or who may be called upon to represent a party in the Employment Tribunal.


With the stated aim of avoiding unnecessary formality, Employment Tribunals are a very different animal to other courts in the UK. This means that parties may be represented at hearings by a range of people including their own HR team or specialist solicitors or barristers. There are particular challenges even for those who already have some advocacy experience in other courts, such as opening a case without an opening submission or examination in chief, presenting a case effectively whilst seated and dealing with unrepresented opponents to name just a few.

This course will provide you with the essential building blocks to prepare and present a case effectively in the Employment Tribunal. You will also gain inside knowledge and tricks of the trade from our experienced presenters.

The course uses case study and discussion throughout the course of the day and culminates in a mini-hearing in which you will participate fully.

Pre-course preparation

Please note this is a practical advocacy course requiring pre-course work, namely reading a case study and preparing a written skeleton argument to be handed in at the start of the course. The pre-course work will be sent to you approximately two weeks before the course, please ensure you read the course papers as soon as you get them as this will allow you to gain maximum benefit from the course.

By the end of this course you will be able to:

  • Deal appropriately with Tribunal staff, Employment Judges and Tribunal Members
  • Appreciate the importance of key documents such as skeleton arguments, chronologies and “cast lists”
  • Prepare effectively for interim hearings whether in person or by telephone
  • Present oral applications for orders before and during a final hearing
  • Appraise and apply techniques for examining witnesses in cross examination and re-examination
  • Prepare and present effective closing submissions

    Under the SRA’s new approach to continuing competence, solicitors are expected to use the Statement of Solicitor Competence to identify and address their learning and development needs. The competence statement requires the following competencies:
