This course will benefit anyone advising in this area, whether in the police station, at the office or in court.

Overview

This course will appeal to anyone advising clients in what can be a difficult area of law. The sections of the Act are not easy to read and the cases are not always easy to follow. Good accurate and comprehensive advice needs to be given to the client at an early stage so that he or she may consider their options in the matter.

You need to be aware of the various tests in order to understand whether or not the client is in danger of being a totter, the relevance of previous disqualifications and the mandatory minimum period of disqualification in certain circumstances. When you’ve got to grips with this you have to understand the law as regards special reasons, exceptional hardship and advising in the area of excess alcohol offending, whether it be in charge, driving or attempting to drive or failing to blow. Next comes the Road Safety Act 2020 and the new offences in relation to causing death by careless driving or whilst unlicensed, uninsured or disqualified. Probationary drivers are a subcategory who may need completely different advice to that relevant for non-probationers.

If this makes the course sound a little daunting, do not be alarmed as road traffic law is not intellectually demanding but it is tricky, and you need to ask yourself the right questions in order to arrive at the right solutions and to be able to advise the client accordingly. By the end of the course you will know at least 100 accurate things about road traffic advice that you may not have known at the start.

Learning outcomes include obtaining a greater understanding of:

  • Drink drive, driving whilst impaired, drunk in charge - know your defences
  • Failing to blow at the police station - mandatory or discretionary disqualification
  • Special reasons/exceptional hardship - don’t confuse the two
  • The new offences under the Road Safety Act 2020 and current sentencing guidelines
  • Know your totting up provisions and the ratcheting up effect of relevant previous disqualifications
  • Driving whilst disqualified - no mention of the public place
  • Disqualification until retest - what does it all mean?
  • Discretionary disqualifications, mandatory disqualifications, interim disqualifications, applications for removal
